Pixel 360 Content License Agreement

This is a license agreement between you and Pixel360 that explains how you can use photos, illustrations, and vectors licensed from Pixel360. By downloading content from Pixel360, you accept the terms of this agreement.

 

 

1. Licenses Offered by Pixel360

Each file downloaded from Pixel360 includes a standard license. Your use of content is subject to the standard license terms.

You may purchase and use credits from Pixel360 to license photos, illustrations, and vectors. Credits can be bought in preset packs or individually, with discounts applied to larger purchases.

You may also use watermarked content from the Pixel360 website for test or sample layouts (composite use) at no cost. However, watermarked content may not be used in final or publicly available materials and is limited to use for 30 days following download.

 

 

2. Use of Licensed Content

Licensed content may be used in ways not restricted under this agreement (see Section 3 for restrictions). Subject to these terms, Pixel360 grants you rights that are:

  • Perpetual: No expiration or end date for content downloaded during your agreement.
  • Non-exclusive: Pixel360 may license the same content to other customers.
  • Worldwide: Use content in any geographic territory.
  • Unlimited: Use content in an unlimited number of projects across any media.

"Use" includes copying, reproducing, modifying, editing, synchronizing, performing, displaying, broadcasting, publishing, or otherwise utilizing the content.

Examples include: websites, blogs, social media, advertisements, marketing campaigns, corporate presentations, newspapers, magazines, books, film and television productions, apps, and product packaging.

Ensure you review Section 3 for exceptions and restrictions.

 

 

3. Restricted Uses

a. No Unlawful Use

You may not use content in any manner that is pornographic, defamatory, illegal, or violates regulations or industry codes.

b. Editorial Use Only

Content marked "Editorial Use Only" may not be used for commercial, promotional, or merchandising purposes. It is intended for descriptive use in editorial contexts such as news reporting or discussion.

c. No Standalone File Use

Content cannot be distributed as a standalone file. It must be integrated into a larger project.

d. No Use in Trademarks or Logos

Content may not be registered as part of a trademark or logo.

e. Sensitive Use Disclaimer

For sensitive subjects, such as health conditions, you must include disclaimers indicating that the content is for illustrative purposes and that individuals depicted are models.

f. No False Authorship

You may not falsely claim authorship of a project that primarily consists of licensed content.

 

 

4. Right to Use the Licensed Content

The rights granted are non-transferable and non-sublicensable. Exceptions include:

  • Employer or Client Use: If purchased on behalf of your employer or client, they may use the content. You must have authority to bind them to this agreement.
  • Subcontractors: Subcontractors may use the content only for production or distribution related to your project.

 

 

5. Seat & User License Restrictions

Licensed content may only be shared within a single legal entity. Only one person can use the content at any given time unless additional licenses are purchased.

 

 

6. User Accounts

You are responsible for all activity under your account. Notify Pixel360 immediately of unauthorized use. Pixel360 reserves the right to monitor activity to ensure compliance.

 

 

7. Intellectual Property Rights

Ownership

All content is owned by Pixel360 or its contributors.

Attribution

No credit is required for commercial use. For editorial use, credit must be provided: "Pixel360/Artist’s Name."

8. Termination and Refunds

Termination

You may terminate this agreement by ceasing all use and deleting the content. Pixel360 may terminate the agreement if terms are violated.

Refunds

Refunds for unused credits may be requested within 14 days of purchase. Downloaded files are non-refundable unless technical issues are verified by Pixel360.

Content Withdrawal

Pixel360 may withdraw content at any time. You must cease use of such content upon notice.

 

 

9. Warranties and Disclaimers

Pixel360 warrants that properly licensed content will not infringe on copyright or trademark rights. However, for "Editorial Use Only" content, no model or property release is guaranteed.

 

 

10. Indemnification and Liability

You agree to indemnify Pixel360 for any damages or costs resulting from misuse of content. Pixel360’s liability is limited to €10,000 per item of content.

 

 

11. General Provisions

Governing Law

This agreement is governed by the laws of England and Wales.

Severability

If any provision is deemed invalid, the remainder of the agreement remains enforceable.

Entire Agreement

This agreement constitutes the entire understanding between you and Pixel360 regarding licensed content.
